1. Who sells
The AI Use Policy Kit and the other digital products offered on vergarameloabogado.site are sold by GRUPO EMPRESARIAL NEW WAY S.A.S., NIT (tax ID number) 901.855.061-7, under the brand «Vergara Melo · Abogado» (the "seller"). 2. Acceptance
These terms govern purchases of digital products on this site. By paying, the buyer confirms having read and accepted them. Anyone buying on behalf of an organization confirms that they are authorized to do so.
3. The AI Use Policy Kit
The kit contains an editable artificial intelligence use policy, a tools matrix, contract clauses and the guide to the three workflows, as editable digital files.
It is general material, designed for each organization to adapt to its own circumstances. It is not legal advice on a specific case: deciding whether and how to adopt it is up to the buyer. A review of the buyer's own case can be contracted separately.
The kit is delivered in the version current on the date of purchase. Later versions are not included unless announced otherwise.
4. Price and payment
The price is COP 189,000. It is the final price and includes any applicable taxes.
Payment is made through Wompi, Bancolombia's payment gateway, with the methods it makes available. The seller neither sees nor stores the buyer's card or account details.
Until the seller enables its own Wompi account, payments are collected in the account of Juan David Vergara Melo, its legal representative, for and on behalf of GRUPO EMPRESARIAL NEW WAY S.A.S. That is why the Wompi receipt shows the legal representative's personal ID. This doesn't change who sells or who is responsible for the purchase.
GRUPO EMPRESARIAL NEW WAY S.A.S. issues the electronic invoice with the identification details the buyer enters when paying.
5. Delivery
The kit is sent to the email address the buyer enters when paying, within 24 hours after Wompi approves the transaction. If it hasn't arrived within that time, after checking the spam folder, the buyer can write to info@vergarameloabogado.site and it will be sent again.
6. Right of withdrawal
The kit is digital content delivered the moment the payment is approved. For that reason, the right of withdrawal (derecho de retracto) under Article 47 of Law 1480 of 2011 does not apply: the contract is performed on delivery, within the five days set by that article, and the files, by their nature, cannot be returned. The buyer accepts this condition by paying.
If the kit doesn't arrive, or arrives incomplete or with damaged files, the seller will send it again and, if that isn't possible, refund the amount paid.
7. Payment reversal
If you paid with a credit card, debit card or another electronic payment instrument, you may request a payment reversal if you were the victim of fraud, if you didn't request the transaction, if you didn't receive the kit, or if what you received doesn't match what was offered or is defective.
To do so, within five business days after you learned of the situation, file your complaint with the seller at info@vergarameloabogado.site and your reversal request with the issuer of the payment instrument (Article 51 of Law 1480 of 2011 and Decree 1074 of 2015).
8. License
The kit is a work protected by copyright (Law 23 of 1982 and Andean Decision 351 of 1993). The purchase grants the buyer a non-exclusive, non-transferable license to use it within their organization, or for their own use if they are an individual:
- They may edit and adapt it, adopt the policy and clauses as their own documents, and share them with their employees and contractors.
- They may publish the adapted policy as a document of their organization.
- They may not resell or redistribute the kit, share it with other organizations or use it as the basis for products or services provided to third parties. Those uses require a separate license.
9. Workshop discount
If the organization that bought the kit contracts the Safe AI workshop within six months of the purchase, the amount paid for the kit (COP 189,000) is deducted from the workshop price. To apply it, just share the payment receipt when requesting the proposal.
10. Workshop and other services
The Safe AI workshop and consulting services are contracted through a specific proposal or contract that sets out the scope, price, payment terms and the conditions of the money-back guarantee announced on the site. These terms do not apply to those services, except as provided in section 9.
11. Personal data
The buyer's data (name, email, ID document, company name and transaction details) is used to deliver the kit, invoice and provide support, in accordance with the Personal Data Processing Policy. Payment details are processed directly by Wompi.
12. Requests, complaints and claims
Requests, complaints and claims are received at info@vergarameloabogado.site and answered within fifteen business days at most. If you aren't satisfied with the answer, you may turn to the Superintendencia de Industria y Comercio (Colombia's consumer protection authority).
13. Governing law and changes
These terms are governed by the laws of the Republic of Colombia. Each purchase is governed by the version in force on the date it was made. Changes are published on this page, stating the date from which they apply.
